Introduction and Acceptance

These Terms and Conditions of Sale govern the relationship between you (the “Customer”) and Penrith Hot Water (referred to throughout as “we,” “us” or “our”). By placing an order or continuing to use this website, you confirm that you have read these Terms and agree to be bound by them. These Terms and Conditions exist to protect both your rights as a customer and our rights as a business.

We may update these Terms and Conditions from time to time without prior notice. Any changes take effect as soon as they are published on this page. It is your responsibility to review the current version of these Terms before placing an order. Continued use of the website after changes are published will be taken as acceptance of the updated Terms.

We aim to keep the website available at all times but cannot guarantee uninterrupted access. We may take the website offline temporarily for maintenance or updates and will keep any downtime to a minimum. We are not liable if any part of the website is unavailable at any time.

Orders and Pricing

Prices

All prices displayed on the website are in Australian Dollars and include GST. Delivery charges and installation costs, where applicable, are identified separately. We reserve the right to change prices at any time, but the price that applies to your order is the price shown at the time you place it.

If an incorrect price is displayed on the website due to a technical error, data entry mistake or any other reason, and the error is not identified before your order is confirmed, we reserve the right to cancel the order and refund any payment already made.

Product Information

We take care to ensure that product descriptions, specifications and images on the website are accurate. However, we cannot guarantee that every detail is free from error, and we accept no liability for inaccuracies in product information provided by manufacturers or third-party sources.

Availability

We will always endeavour to fulfil your order once it has been placed and paid for. If a product becomes unavailable after payment, we will issue a refund for that product within 30 days of the date of payment.

If your order contains multiple items and some are temporarily out of stock, we may dispatch the available items first and send the remaining items once they are back in stock. Where appropriate, we may offer a replacement product of equivalent price and quality. If you accept a replacement and later wish to return it under the returns policy below, we will cover the cost of return postage. If you decline the replacement and the original product is permanently unavailable, we will refund the price of the unavailable product.

Payment

The website accepts Visa and Mastercard. Payment is processed using SSL encryption to keep your transaction secure.

Delivery

Orders will be delivered to the address provided at checkout. We deliver hot water systems across Penrith and the surrounding Western Sydney region. Delivery to addresses outside our standard service area may be available on request and may incur additional charges.

All deliveries are made via standard vehicle road access. If water or air freight is required, you may arrange a third-party transport or logistics provider and we will deliver the item to that provider on your behalf. In that case, you accept full responsibility for any additional costs, coordination and any damage that occurs during third-party transport. We accept no responsibility for damage or costs arising from third-party freight arrangements.

We make every reasonable effort to meet the delivery timeframes indicated on the website. We cannot be held responsible for delays or lost shipments caused by a third-party carrier, by incorrect delivery details provided by the customer, or by events outside our control. If a delivery is not received, we will lodge an investigation with the carrier on receipt of your claim. This process may take several working days, during which no refund or replacement will be issued.

Items are delivered to street level or driveway only. If you need an item moved elsewhere on the property, you will need to arrange this at your own cost.

Returns and Refunds

Right of Return

You have 7 days from the date of delivery to return a product you are not satisfied with. To exercise this right, you must return the product within the 7-day period at your own expense, together with your invoice and a completed returns form.

We recommend sending returns by registered post and purchasing transit insurance for the full value of the goods. Return shipping costs remain the customer’s responsibility unless otherwise agreed. The right of return applies only to products returned in their original, complete and unused condition. Products that have been installed, damaged, or returned without original packaging will not be eligible for a refund.

Some products may attract a restocking fee of up to 20%, reflecting costs charged to us by manufacturers and suppliers. We will advise you of any applicable restocking fee before processing the return.

Refund Method

Where a return meets the conditions above, the refund will be issued using the same payment method that was used to place the original order.

Installation

Installation services are available across Penrith and the surrounding Western Sydney area. Installation outside our standard service area may be arranged at our discretion and may attract additional charges.

Installation prices shown on the website are based on a standard installation that meets current plumbing regulations. Pricing assumes straightforward access to the existing hot water system and that existing valves and fittings are in serviceable condition. We do not take responsibility for pre-existing valves or fittings that leak or fail during or after installation. Where existing components need to be replaced, we will provide a separate price for that work before proceeding.

We reserve the right to decline an installation for any reason, and we reserve the right to apply additional charges where site conditions differ from what was expected at the time of quoting, particularly where safety is a factor.

Privacy and Personal Information

The personal details you provide are used to process and deliver your order, manage billing, and set up any applicable warranty arrangements. Failure to provide accurate details may result in delays or cancellation of your order. By creating an account or placing an order, you agree to provide truthful and accurate information.

You have the right to access and correct any personal information we hold about you, in accordance with Australian privacy law. You can request a copy of your personal information, or request corrections, at any time by contacting us.
